Exceptional admission to residence: regularization explained

Living and working in France without a residence permit is a precarious situation. Exceptional admission to residence (AES) can, in some cases, open a path to regularization. Here are the possible grounds and their conditions in 2026.
What is AES?
AES is a discretionary decision by the prefect: even if you meet the conditions, admission is not an automatic right. It can be requested on several grounds, mainly work and private and family life.
Regularization through work
Two routes coexist:
- The classic route: length of presence and work in France, with a job offer or a contract, assessed by the prefect.
- Shortage occupations (scheme from the law of 26 January 2024, applicable until 31 December 2026): having worked at least 12 months (consecutive or not) over the last 24 months in a shortage occupation and area; holding such a job at the time of the application; proving at least 3 years of uninterrupted residence in France.
Regularization on “private and family life” grounds
It is based on the strength of personal and family ties in France (length of presence, family life, children’s schooling, etc.). Each situation is assessed on a case-by-case basis.
Exclusions
Some situations close the door: a threat to public order, polygamy, or having been subject to an OQTF in the previous three years. Putting together a coherent, complete file is decisive.
