Married to a French national? You can acquire nationality by declaration, without waiting for the 5 years of residence required for naturalization by decree. Here are the exact 2026 conditions and the pitfalls to avoid.

Acquiring French nationality through marriage is not a “classic” naturalization: it is a declaration. If the conditions are met, the administration can only object on specific grounds (lack of assimilation, unworthiness, threat to public order).

The marriage durations to meet

The declaration is possible after 4 years of marriage, provided that the community of life (emotional and material) has not ceased since the marriage. This period is extended to 5 years if, at the time of the declaration, you cannot prove regular and uninterrupted residence of at least 3 years in France since the marriage.

Key condition

The community of life must be real and ongoing. The administration can verify it, including through an investigation.

The required French level

Since 1 January 2026, the spouse must prove a B2 level of French (up from B1 previously). This increase applies to declarations filed from that date. The level is proven by a diploma or a recognized test (TCF, TEF).

Assimilation and respect for values

As with naturalization by decree, you must demonstrate your assimilation : sufficient knowledge of the language, but also of the rights and duties of a French citizen, and adherence to the principles of the Republic. An interview may be arranged.

Does divorce after the declaration jeopardize nationality?
Once nationality is acquired and the procedure completed, a later divorce has in principle no retroactive effect. However, the end of the community of life before registration can bar the declaration.
Do you have to live in France to declare?
No, the declaration is possible even while residing abroad, but the required marriage period is then 5 years and community of life is still required.
Does a civil partnership (PACS) grant the same rights?
No. Acquisition by declaration concerns marriage. A civil partnership (PACS) does not open this route, even if it can count in the assessment of other residence procedures.
What happens if the administration objects?
